Austrian Lotteries Online Gambling Monopoly Affirmed
Austrian High Court has made a decision this week in which it rejected an appeal by online gambling companies Bet-At-Home, Lotelo and Bandal that a 15-year exclusive deal awarded to Casinos Austria subsidiary Austrian Lotteries was unconstitutional.

As a matter of fact, the last year award of the long-running exclusive contract for lottery and i-gaming empowered Lotteries Austria to offer online lottery, casino and poker gambling within Austrian borders under the Win2Day brand with effect from October 2012.

The rejected litigation was launched against the Finance Ministry decision in the Vienna-based Constitutional Court. The appellants, tender submitters, alleged tender drafting that favoured Austrian Lotteries claiming that the exclusivity of the deal and the financial requirements it imposed were unconstitutional.
